In some instances, we may manually review communications to debug, improve, and expand product offerings, especially for fraud investigations and customer support, or to assess and improve the functionality of automated tools. It's important to note that we will not scrutinize, scan, or analyze your messaging communications to send third-party marketing messages to you, and we will not sell reviews or analyses of these communications. Additionally, we may share your communications as outlined in the "Sharing & Disclosure" section.

4.1 Sharing With Your Consent or at Your Direction.

In compliance with applicable law, we may use certain de-identified information, like your email address, shared with social media platforms to generate leads, drive traffic to OpenMicz, or promote our products and services.

Parts of your public profile and other accessible content may be displayed on third-party sites, platforms, and apps. Publicly shared OpenMicz Platform information may be indexed by third-party search engines.

4.4 Host Service Providers.

Hosts have the option to utilize third-party services for the management or delivery of their services, such as advanced food services, coat check or valet services at the space venue. Through features on the OpenMicz Platform, Hosts can leverage these services to share specific information about the Producer, including event start and end details, Producer name, and Producer phone number, with the designated third-party service providers.

4.5 Compliance with Legal Requirements, Response to Legal Requests, Prevention of Harm, and Protection of Rights.

We may divulge your information to courts, law enforcement, governmental or public authorities, tax authorities, authorized third parties, or other Users, as required or permitted by law or when disclosure is reasonably necessary to: (i) fulfill our legal obligations. (ii) respond to a valid legal request, such as a subpoena or court order, or address claims against OpenMicz. (iii) address a valid legal request related to a criminal investigation, addressing alleged or suspected illegal activity, or responding to any other activity that may expose us, you, or any other user to legal or regulatory liability. (iv) enforce and administer agreements with Users, including our Terms, and Policies. (v) protect the rights, property, or personal safety of OpenMicz, its employees, its Users, or the public. We may notify Users about legal requests unless: (i) providing notice is prohibited by the legal process, court order, or applicable law. (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm, or increase the risk of fraud upon or harm to OpenMicz, our Users, or expose OpenMicz to a claim of obstruction of justice.

In jurisdictions where required or permissible by applicable law, we may disclose information of Hosts, Performers and/or Producers to tax authorities or other governmental agencies. This is done for the purpose of enabling tax authorities to determine compliance with relevant tax obligations.
The disclosed information may include, but is not limited to, Host, Performer and Producer names, space listing addresses, Host addresses, tax/business identification numbers, date of birth, contact information, payout details, transaction dates and amounts, number of events and the Producers that booked, gross and net booking value, payout amounts, and taxes collected by OpenMicz on behalf of Producers, Performers and Hosts, to the extent known by OpenMicz.

In jurisdictions where OpenMicz is involved in facilitating or requiring registration, notification, permits, or license applications or numbers for a Host with a governmental authority, information about participating Hosts may be shared with the relevant authority. This includes the Host's full name and contact details, Space listing address, tax identification number, registration, permit, or license number, Listing details, booking information, and number of hours or events booked, subject to applicable laws.

4.6 Engagement with Service Providers.

We share personal information with both affiliated and unaffiliated service providers (including their own service providers) to facilitate various aspects of our business operations and ensure compliance. These service providers assist us in tasks such as: (i) verifying your identity or authenticating identification documents. (ii) cross-checking information against public databases. (iii) conducting background checks, fraud prevention, security investigations, and risk assessments. (iv) undertaking product development, maintenance, and debugging. (v) enabling the provision of OpenMicz Services through third-party platforms and software tools (e.g., via API integration). (vi) providing customer service, advertising, or payment services. (vii) offering additional services based on your preferences. (viii) processing, handling, or evaluating insurance claims or similar claims. (ix) reviewing, scanning, and analyzing communications on the OpenMicz Platform for specific purposes.

These service providers are contractually obligated to safeguard your personal information, and their access is restricted to performing these designated tasks. It's important to note that other Users may utilize services outside of OpenMicz's control to process your data, such as email management software, which will be subject to applicable data protection laws worldwide.

4.7 Business Transfers.

In the event of any merger, acquisition, reorganization, asset sale, bankruptcy, or insolvency involving OpenMicz, we may sell, transfer, or share some or all of our assets, including your information. This may occur in connection with such a transaction or as part of the due diligence process. Prior to the transfer of your personal information and its exposure to a different privacy policy, we will notify you.

Certain components of OpenMicz may connect to external services. It's important to note that OpenMicz does not possess authority or oversight over these third-party entities. If you linked your OpenMicz Account to a third-party service, you have the option to adjust your settings and disconnect from that service within your Account settings. It is your responsibility to ensure the accuracy and currency of your personal information.

In certain jurisdictions, you have the right to request the deletion of your personal information. However, it's important to note that if you request the deletion of your personal information or if your account is suspended, terminated, or voluntarily closed:
