Host Cancellation Policy

While Host cancellations are infrequent and may sometimes be beyond their control, they can adversely affect a Producer's professional standing and community trust. In the event that a Host cancels a confirmed booking for Host Services or is deemed responsible for a cancellation under this Policy, OpenMicz may impose fees and other repercussions. The specified fees and consequences are structured to mirror the costs and overall ramifications of such cancellations on Producers, Performers, the Host community, and OpenMicz. In cases where Hosts cancel due to Extenuating Circumstances or valid reasons beyond their control, certain fees and consequences might be exempted, although such exemptions are not guaranteed.

In the event of a Host canceling a confirmed booking or being deemed responsible for a cancellation under this Policy, fees will be imposed, with a minimum cancellation fee of $10.00 USD. The fee is calculated based on the booking amount and the timing of the cancellation:

• If the booking is canceled 48 hours or less before the event’s start time, or after the event has started, the fee is 50% of the booking amount.
• If the booking is canceled anytime between 48 hours and 30 days before the event’s start time, the fee is 25% of the booking amount
• If the booking is canceled more than 30 days before the event’s start time, the fee is 10% of the booking amount

In assessing cancellation fees, the cancellation fee is based on the total booking amount, excluding Producer fees. Should the computed cancellation fee be less than $10.00 USD, it will be adjusted to meet the minimum of $10.00 USD.

Cancellation fees are typically subtracted from the subsequent payout(s) to the Host, following the guidelines specified in the Payments Terms of Service. In addition to the fees and consequences delineated in this Policy, Hosts who cancel or are deemed responsible for a cancellation will lose the payout for the canceled booking. If the payout has already been processed, the corresponding amount will be withheld from the subsequent payout(s).

We may exempt Hosts from the fees outlined in this Policy under specific circumstances, such as if the cancellation is due to Extenuating Circumstances beyond the Host’s control. Hosts asserting eligibility for such exemptions must furnish documentation or supporting evidence. Our decision to waive fees and other consequences will be based on a thorough assessment of the provided evidence.

Even if fees are waived, additional consequences, such as blocking a Listing’s availability, may still be enforced. Regardless of fee waivers or other consequences, the Host will not receive a payout for the canceled booking.

Beyond the imposition of a cancellation fee, there may be additional repercussions, including restrictions on the Host's ability to transact another booking for the affected Listing. Hosts who cancel confirmed bookings without a valid reason may encounter further consequences, as detailed in our Terms of Service. These repercussions could involve the suspension or removal of the Host's Listing(s) or entire account.

A Host may be deemed responsible for a cancellation if it arises due to conditions in the Listing that significantly deviate from the way the Listing was described at the time of booking. In such instances, the Host will be liable for the stipulated fees and additional consequences outlined in this Policy, regardless of whether the cancellation is initiated by the Host or the Producer. Examples of such situations may include double-booking a Listing, substituting another space for the booked Listing without prior, written consent by the Producer, or presenting gross inaccuracies in the Listing that substantially disrupt a Producer's event or workshop, such as falsely advertising a stage when no stage is available for use by Producers.

If a Host is unable to fulfill a booking, regardless of the cause, it is their responsibility to promptly cancel to afford the Producer sufficient time to make alternative plans. Hosts must refrain from encouraging the Producer to cancel the booking in order to avoid penalties, or consequences as outlined in our Terms of Service. Providing false statements or materials in connection with this Policy is a violation of our Terms of Service and may lead to account termination and other consequences. This Policy is applicable to cancellations taking place on or after the effective date. The right of Producers or Hosts to initiate legal action remains unaffected. Any modifications to this Policy will be carried out in accordance with our Terms of Service. This policy is applicable to Space bookings only and does not extend to Event bookings, which has its own terms.
