Extenuating Circumstances Policy

Effective Date: January 28, 2024
Last Updated: January 28, 2024
Overview

This Extenuating Circumstances Policy outlines the procedures for handling cancellations in situations where unforeseen incidents beyond your control occur after booking, rendering it nonviable or illegal to proceed with the booking. The Policy is applicable to all Host Services.

In instances where this Policy permits cancellation, it supersedes and takes precedence over the booking's regular cancellation policy. Producers affected by an incident covered by this Policy have the option to cancel their booking and, depending on the circumstances, may be eligible for a refund, booking credit, and/or other considerations. Hosts impacted by an incident covered by this Policy can cancel without facing adverse consequences.

What incidents are covered

This Policy utilizes the term "Incident" to denote situations that arise post-booking, are unforeseen at the time of booking, and hinder or legally prohibit the fulfillment of the reservation.

Modifications to government travel prerequisites. Unanticipated alterations to visa or passport conditions mandated by a governmental agency that impede travel to the destination. This excludes instances of lost or expired travel documents or other personal circumstances related to a Producer's travel authorization.

Declared emergencies and epidemics. Instances where a government formally declares local or national emergencies, epidemics, pandemics, or public health emergencies. Exclusions encompass diseases that are endemic or routinely associated with a specific region, such as malaria in Thailand or dengue fever in Hawaii.

Government travel restrictions. Travel restrictions mandated by a governmental agency preventing or prohibiting travel to, lodging at, or return from the Listing location. Exclusions pertain to non-binding travel advisories and analogous guidance issued by government entities.

Military actions and other hostilities. Civil unrest, rebellions, riots, insurrection, terrorism, explosions, bombings, hostilities, invasions, civil war, and acts of war.

Natural disasters. Events such as natural disasters, acts of God, volcanic eruptions, tsunamis, large-scale outages of essential utilities, and other severe and abnormal weather incidents are covered by this provision. It is important to note that common and foreseeable weather or natural conditions in a specific location, such as hurricanes during hurricane season in Florida, are excluded from this category.

What is not covered

Everything else. This Policy exclusively permits cancellations for the specifically described Incidents mentioned earlier. All other circumstances are explicitly excluded. Instances not covered by this Policy include unexpected disease, illness, or injury; government obligations such as jury duty, court appearances, or military duties; travel advisories or other government guidance that do not constitute a travel ban or prohibition; cancellations or rescheduling of events for which the booking was made; and transportation disruptions unrelated to a covered incident, such as road closures, as well as flight, train, bus, and ferry cancellations. In cases where a booking is canceled under these excluded circumstances, the amount refunded will be determined by the cancellation policy applicable to the booking.
