Event Cancellation Policy

The Event Refund Policy outlines the procedures for handling refunds in the event of a Host cancellation of an event they created at their own space acting in the capacity as the Producer, or a Producer cancellation as part of the Host Services provided by an Space Host, or other disruptions to an Event organized by either Host or Producer on the OpenMicz platform.. What Event Issues are covered

The term “Event Issue” refers to the following situations:

Canceling an Event
Created by a Host

In the event of a Host canceling an Event or another Event Issue causing disruption, the Host will not receive any compensation for this disruption. The Host’s only recourse will be to leave a public review detailing the incident. Additionally, the Host may incur cancellation penalties in accordance with our Terms of Service and Payments Terms of Service.

Created by a Producer

If a Producer cancels an Event, the Host will receive their regular payout as per our Payments Terms of Service, less any service fees.

What occurs in case of another Event Issue affecting an Event

Any other Event Issues should be promptly reported to us, no later than 1 hour after their occurrence. Upon confirming that an Event Issue has disrupted an Event, we will offer a full or partial refund, or other considerations as we deem appropriate and at our sole discretion. The refunded amount is contingent on the severity of the Event Issue, its impact on the Producer, the manner in which the Event was influenced, and whether the Producer could make use of the Host Services during the Event.

Requesting a Refund

To be eligible for a refund associated with an Event Issue, excluding Host or Producer cancellations, the affected party may initiate a refund request by sending an email or contacting us by phone. Such requests must be submitted to us within 4 hours of the Event Issue and should include relevant evidence, such as photographs or confirmation of the conditions provided by the Host, Producer, Performer, or relevant party. Our determination of the existence of an Event Issue will be contingent upon an assessment of the evidence presented.

Policy’s Affect on Hosts

In case of a Host cancellation of an Event booking or the occurrence of another Event Issue disrupting an Event, the Host will either receive no payout, or their payout will be decreased by the amount refunded to the Producer and any affected third parties i.e. Performers. In most situations, we will endeavor to validate the Producer's request with their Host. Hosts also have the option to raise an objection to an Events Issue by reaching out to us via email or phone.

Other things to be aware of

This Policy is applicable to all reservations made on or after the Effective Date above, taking precedence over the reservation’s cancellation policy when it applies. Prior to requesting a refund, if feasible, the Producer should inform the Host and attempt to address the Events Issue directly. We may adjust the refund amount under this Policy to account for any relief directly provided by the Host.

If a Producer demonstrates that prompt reporting of an Events Issue was not feasible, late reporting may be allowed under this Policy. Events Issues caused by the Producer, or their co-Producers, or their Performers, are not covered. Submitting a fraudulent report violates our Terms of Service and may lead to account termination.

Decisions under this Policy are binding but do not affect other contractual or statutory rights. Producers' and Hosts' rights to initiate legal action remain unaffected. This Policy is not insurance, and no premium has been paid. All rights and obligations are exclusive to the booking’s Producer and Host and may not be transferred. Changes to this Policy will follow our Terms of Service. This Policy applies to Events but not to Space bookings.
